Apartment Lease Information

A lease is a contract between the property owner and the tenant renting or leasing the property. The lease explains in writing the rights and responsibilities of the parties entering the contract. It is a legal agreement that specifies that the property owner is giving possession of the property to you for a specified period of time. It states what you can do or cannot do to posses and retain the property.  When either party fails to keep up their share of responsibilities it is considered breach of contract and the necessary action is taken like penalty, mediation, small claims court, or other courts.

In general the lease is drafted by the property owner in accordance with the rental laws and includes clauses favoring the property owner. If there are clauses that the tenant disagrees with those can be modified or deleted with mutual consent. Unlike negotiating for a home price negotiating terms on the lease is not simple but possible. When you want to negotiate on a lease come prepared with the knowledge of the current market, laws, and rights. Communicate well, keep an open mind, and ask questions to equip yourself. Get all details in writing and establish an honest relationship. You can negotiate in getting a longer lease avoiding rent increase for the first year and also get a price reduction in exchange for regular maintenance by yourself.

Leases are signed by both the tenant and the property owner. Any oral agreement is not valid in case of a dispute so have all agreement in writing. Usually the lease contains details of the property being rented, period of rent, rules, and regulations, rent payment details, security deposit information, utilities and appliances, occupancy, sublet, rent acceleration, right of entry, renewal, etc.

A lease usually has a lease break clause mentioning the steps taken when you want to get out of the lease earlier than its expiry or you broke some other clause in the lease that requires you to be evicted. Some of the lease-break steps include forfeiting the security deposit, paying the rent until the expiry date or paying rent until the apartment is rented out whichever occurs first, finding the next tenant yourself, etc.

There are circumstances under which you can get out o the lease without penalty.  When your property is seriously damaged and becomes inhabitable by no fault of yours you can break the lease. If you are called to active duty in military or sometimes transferred by military orders you are allowed to break the lease. Laws in some states allow you to break the lease without penalty if you are seriously injured or sick or need to move to assisted living.
